Privacy Policy

1. Who we are

HairCare Pro ("we", "us") operates shophaircarepro.com. This policy explains what personal information we collect through this website, our online store, by phone and through our advertising, how we use it, who we share it with, and the choices you have.

We follow Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), Quebec's Act respecting the protection of personal information in the private sector where it applies, and the privacy laws of the US states where they apply to us (section 12).

3. What we collect

Information you give us. When you contact us, sign up for offers, book training, take our hair quiz, chat with us, call, text or email, we collect what you provide: usually your name, email address, phone number and the details of your request or quiz answers.

Orders and accounts. When you buy from us or create an account, we collect your name, email, phone number, billing and shipping addresses, and what you ordered. Checkout and payment are handled by Shopify and its payment processors. We never see or store your full card number. Your cart, wishlist and sign-in may be saved in your browser's local storage so they are still there when you come back.

Phone calls. Some phone numbers on this website may be tracking numbers. When you call one, we collect the number you called from, the time and length of the call, and the web page, ad or search that led you to call. Calls are recorded for quality and training.

Information collected automatically. When you visit, we and the services in section 6 collect your IP address, device and browser type, the pages you view, the page that referred you, your country and approximate location based on your IP address, and campaign codes in the link you followed (such as gclid, fbclid, ttclid, msclkid and UTM tags). We use your country to show the right store and prices. This uses cookies, pixels, local storage and similar technologies.

Information from others. Advertising platforms and our marketing partners may tell us which ad, campaign or search led to your visit, purchase or enquiry, and give us statistics about our audience.

Please don't send us sensitive information, such as health or financial details, through this website's forms.

4. How we use it

• To fill your orders, run your account and answer your questions.
• To run and protect this website, including filtering spam and fraud.
• To understand how the website is used and improve it.
• To measure which ads, searches and campaigns lead to visits and sales.
• To show our ads to people who have visited this website, or who are similar to our customers.
• To send you marketing emails or text messages, only where you have agreed or the law allows it (section 13).
• To meet our legal, tax and accounting obligations.

5. Cookies and similar technologies

We group the technologies on this website into four categories:

• Necessary: security, your cart, sign-in, the country you're shopping from and the basic working of the website.
• Analytics: how visitors use the website, and which pages and campaigns lead to sales.
• Advertising: measuring our ads and showing them to people who have visited this website.
• Embedded content: some pages show videos or maps from other services, which may set their own cookies when they load or play.

You can block or delete cookies in your browser's settings, although some parts of the website, such as the cart, may not work without the necessary ones. To limit advertising, use the platform settings in section 7.

6. Services we use

We use the services below to run this website and our marketing. Not every service is used on every page or at all times. Each one processes information on our behalf under its own privacy policy.

7. Advertising and your ad choices

We advertise on Google, Meta (Facebook and Instagram), TikTok and Microsoft Bing. These platforms may use cookies and information about your visit to show you our ads on other websites and apps, and to tell us how well the ads work.

We may also send these platforms information directly from our systems, not through your browser:

• a record that a purchase or enquiry took place, so they can tell us which ad led to it;
• customer email addresses or phone numbers, in scrambled (hashed) form, to measure our ads, show ads to existing customers, or leave them out of ads.

Browser settings cannot stop these transfers because they don't happen in your browser. To be left out of them, contact our Privacy Officer (section 2).

You can manage ads from each platform:

• Google: My Ad Center and the Google Analytics opt-out add-on
• Meta: Ad preferences
• TikTok: Settings and privacy > Ads, in the TikTok app
• Microsoft: Ad settings
• Many advertisers at once: YourAdChoices.ca in Canada, or optout.aboutads.info in the United States

8. Who we share it with

• Service providers, including those in section 6, and our marketing agency, Viacore Media, which manages this website and our advertising on our behalf. They may use your information only to provide their services to us.
• Shipping carriers, to deliver your order.
• Authorities, where the law requires it or to protect our rights, our customers or the public.
• A buyer or successor, if our business is sold or merged, under the same protections as this policy.

We do not sell your personal information for money. Some US state laws treat advertising cookies as a "sale" or "sharing"; section 12 explains how to opt out.

9. Information stored outside your country

Most of the services in section 6 store information in the United States, and some in Canada, the European Union or other countries. Information held there may be accessed by courts and authorities under those countries' laws. Before information about Quebec residents leaves Quebec, we assess whether it will be adequately protected.

10. How long we keep it

We keep enquiries and customer records for three years after our last contact with you, and order records for at least six years, as tax law requires. Analytics and advertising data is kept for the period set in each service, for example up to 14 months in Google Analytics. Then we delete it or make it anonymous.

11. How we protect it

We limit access to the people and providers who need it, use encrypted connections (HTTPS), and choose providers that keep information secure. If a breach creates a real risk of significant harm, we will tell you and the regulators as the law requires.

12. Your rights

You can ask us to:

• tell you what personal information we hold about you, and give you a copy;
• correct it;
• withdraw your consent, for example to marketing or tracking;
• delete it, where we no longer need it or the law does not require us to keep it.

In Quebec you can also ask for your information in a structured, commonly used technological format, and ask us to stop spreading or de-index information about you. We do not make decisions about you based only on automated processing.

If you live in the United States. Some state laws, such as California's, give residents the right to know what personal information we hold, delete it, correct it, and opt out of its "sale" or "sharing" for targeted advertising, which may include advertising cookies. To use these rights, contact our Privacy Officer; you can also limit advertising with the settings in section 7. We will not treat you differently for using them.

Send requests to our Privacy Officer (section 2). We may need to confirm your identity, and we reply within 30 days. If you're not satisfied, you can complain to the Office of the Privacy Commissioner of Canada, in Quebec to the Commission d'accès à l'information, or in the United States to your state's attorney general.

13. Email and text messages

We send marketing emails or texts only when you have agreed to receive them, for example by ticking the box when you sign up, or where the law allows it, such as after a recent purchase. Every message lets you unsubscribe: use the link in the email or reply STOP to a text.

No mobile information will be shared with third-parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third-parties.

14. Children

This website is not meant for children under 16, and we do not knowingly collect their information. If you think a child has given us information, contact us and we will delete it.

15. Changes to this policy

We may update this policy when our services or the law change. We'll post the new version here with a new "Last updated" date.
